Agreement to Terms

By accessing or using discoverkit ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

Description of Service

discoverkit is a pain point aggregation and discovery platform that helps aspiring founders, indie developers, and solo builders find validated startup ideas by surfacing real problems from Reddit, HackerNews, and other platforms. We provide curated signals, pain point analytics, and market insights based on publicly available data.

User Accounts

When you create an account with us, you agree to:

• Provide accurate, current, and complete information
• Maintain the security of your password and account
• Promptly update your account information if it changes
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate your account if you provide inaccurate, false, or incomplete information, or if you violate these Terms.

Subscription and Billing

Some parts of the Service are billed on a subscription basis ("Subscription"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set on a monthly basis.

• Free Tier: Limited access to pain points and signals with usage quotas
• Pro Tier ($49/month): Unlimited access to all pain points, signals, and premium features

At the end of each Billing Cycle, your Subscription will automatically renew unless you cancel it or we cancel it. You may cancel your Subscription renewal through your account settings or by contacting us.

Payment and Refunds

Payment processing is handled securely by Stripe. By providing payment information, you:

• Represent that you are authorized to use the payment method
• Authorize us to charge your payment method for the subscription fee
• Agree to pay all fees and applicable taxes

Refund Policy: Due to the digital nature of our service and immediate access to data, we generally do not offer refunds. However, we may consider refund requests on a case-by-case basis for exceptional circumstances. Please contact us at support@discoverkit.com to discuss.

Acceptable Use

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction
• Attempt to gain unauthorized access to the Service or related systems
• Use automated tools (bots, scrapers) to access the Service without permission
• Transmit any viruses, malware, or harmful code
• Interfere with or disrupt the Service or servers
• Impersonate another person or entity
• Harass, abuse, or harm other users
• Collect or store personal data about other users
• Resell or redistribute the Service or data without authorization

Data and Content

Our Content: All pain points, signals, and market data provided by discoverkit are aggregated from publicly available sources. We do not guarantee the accuracy, completeness, or usefulness of this information.

Your Content: You retain ownership of any content you submit (e.g., saved pain points, feedback). By submitting content, you grant us a license to use, store, and display it as necessary to provide the Service.

Attribution: Pain points and signals are sourced from public platforms Twitter. We provide attribution and links to original sources where applicable.

Intellectual Property

The Service and its original content (excluding user content and public data), features, and functionality are owned by discoverkit and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without explicit permission.

Disclaimers

No Warranties: The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Accuracy, reliability, or completeness of pain points and signals
• Suitability of identified opportunities for your specific situation
• Uninterrupted or error-free operation of the Service
• Security of data transmission

Limitation of Liability

To the maximum extent permitted by law, discoverkit and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of (or inability to access or use) the Service
• Any conduct or content of any third party on the Service
• Unauthorized access, use, or alteration of your content
• Business decisions made based on information from the Service

In no event shall our total liability exceed the amount you paid us in the twelve (12) months prior to the claim, or $100, whichever is greater.

Indemnification

You agree to indemnify, defend, and hold harmless discoverkit and its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or expenses arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) your content.

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may do so through your account settings or by contacting us.

Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through a prominent notice on the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which discoverkit operates, without regard to conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts of that jurisdiction.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Entire Agreement

These Terms constitute the entire agreement between you and discoverkit regarding the Service and supersede all prior agreements and understandings, whether written or oral.
